Workers' compensation coverage is a statutory requirement and is mandatory in all states except Texas and New Jersey. The employer is responsible for the cost of workers' compensation insurance and cannot legally require an employee to pay any of this cost.
The workers' compensation system provides no-fault coverage for workers sustaining an injury or illness on the job. An injury or illness can result from a specific work-related accident or may occur over time during the course and scope of employment. The statutory benefits available to injured workers include medical care to treat the injury, as well as indemnity payments for lost wages.
